Consumer Fraud Cases

A consumer fraud case often involves a business that engages in deceptive business practices. These practices can include overcharging for a product or service, false advertising or misrepresenting the characteristics of a good or service. Many states, including Missouri and Illinois, have specific statutes that protect consumers from deceptive or unfair business practices. These statutes are commonly referred to as UDAP statutes (Unfair and Deceptive Acts and Practices). Missouri’s UDAP statute is known as the Merchandising Practices Act (MPA). The Illinois UDAP statute is known as the Consumer Fraud and Deceptive Business Practices Act. For the Missouri and Illinois statutes to apply, a consumer must have purchased a good or service for personal or household use.
